BOOKKEEPING AND ACCOUNTING

FIRPTA transactions
The disposition of a U.S. real property interest by a foreign person (the transferor) is subject to the Foreign Investment in Real Property Tax Act of 1980 (FIRPTA) income tax withholding. FIRPTA authorized the United States to tax foreign persons on dispositions of U.S. real property interests.
A disposition means “disposition” for any purpose of the Internal Revenue Code. This includes but is not limited to a sale or exchange, liquidation, redemption, gift, transfers, etc. Persons purchasing U.S. real property interests (transferees) from foreign persons, certain purchasers’ agents, and settlement officers are required to withhold 15% (10% for dispositions before February 17, 2016) of the amount realized on the disposition (special rules for foreign corporations).
Depending on each circumstance, such withholding may be reduced or even eliminated. Our Firm has the experience and a good record of success in accomplishing this.

ITIN APPLICATION — CAA SERVICES
A Certified Acceptance Agent is a person or an entity (business or organization) who, pursuant to a written agreement with the IRS, is authorized to assist individuals and other foreign persons who do not qualify for a Social Security Number (SSN) but who still need an Individual Taxpayer Identification Number (ITIN) for several different purposes. The Certified Acceptance Agent facilitates the application process by reviewing the necessary documents, authenticating the identity when able and forwarding the completed Forms to IRS.
Our Firm is a subscriber to one such agreement, which can help our clients to expedite the application process by significantly reducing the turnaround time of original documents and providing a close follow up system through the IRS CAA Hotline. ITIN application interviews can be performed by means of a videoconference system when the applicant is at a remote location in the US or abroad.

Report of Foreign Bank and Financial Accounts (FBAR)
If you, as a U.S. citizen or resident, have a financial interest in or signature authority over a foreign financial account, including a bank account, brokerage account, mutual fund, trust, or other type of foreign financial account, exceeding certain thresholds, the Bank Secrecy Act may require you to report the account yearly to the Department of Treasury by electronically filing a Financial Crimes Enforcement Network (FinCEN) 114, Report of Foreign Bank and Financial Accounts (FBAR).
We are a BSA E-filer and can assist you in filing this very important report in order to avoid significant penalties.
